Judicial Scrutiny Intensifies Over Pending Dues

CHANDIGARH: In a stern administrative rebuke, the Punjab and Haryana High Court has imposed a cost of Rs 1 lakh on the Punjab Chief Secretary for failing to comply with judicial directives regarding the release of Dearness Allowance (DA) and Dearness Relief (DR) arrears. The court's ruling marks a significant escalation in the ongoing legal battle between state government employees and the administration over withheld financial entitlements.

Personal Appearance Mandated

During the recent proceedings, the bench expressed strong dissatisfaction with the state government's persistent delays in disbursing the pending DA and DR benefits to its active employees and pensioners. Addressing the non-compliance, the court directed the Chief Secretary to make a personal appearance during the upcoming hearing scheduled for November 3. Furthermore, the top bureaucrat has been instructed to submit a detailed personal affidavit accounting for the administrative inertia.

Legal representatives for the aggrieved employees highlighted procedural delays on the part of the state, pointing out that a Special Leave Petition (SLP) filed by the government before the Supreme Court had languished on the defect list for over two months without rectification.

Disparity in Treatment Questioned

Judicial scrutiny during the hearing also zeroed in on what the bench termed an apparent disparity in financial administration. The court questioned why the statutory benefits of ordinary government employees and pensioners continued to be withheld under fiscal pretexts, while senior state officials and administrators faced no such delays in receiving their complete financial dues.

The upcoming November 3 hearing is anticipated to be a critical juncture, as the High Court evaluates the state administration's formal response and the steps taken to rectify the prolonged delay in honoring financial commitments to its workforce.
